Please read these Terms of Service ("Terms") carefully before using the Zestro mobile application ("App") operated by Parallax Labs LLC ("we", "us", or "our"), a limited liability company registered in the State of New Mexico, United States.

By downloading, installing, or using Zestro, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account and using Zestro, you confirm that you are at least 13 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you are using Zestro on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

2. Description of Service

Zestro is an AI-powered voice cooking companion that provides personalised meal suggestions and step-by-step voice-guided cooking sessions adapted to each user's dietary conditions, health needs, fitness goals, skill level, and preferences.

Important: Zestro is a cooking guidance application only. It does not provide medical advice, clinical nutritional guidance, or dietary treatment of any kind. Nothing in the App should be interpreted as medical advice. Always consult a qualified healthcare professional or registered dietitian for medical dietary decisions, particularly if you are managing a health condition such as diabetes, food allergies, PCOS, or any other condition that requires medically supervised dietary management.

3. Account Registration

To use Zestro you must create an account using a valid email address, Apple ID, or Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to keep your information up to date.

You may not create more than one account per person. Creating multiple accounts to abuse the free trial system is a violation of these Terms and may result in immediate termination of all associated accounts.

4. Free Trial

Zestro provides eligible new users with a seven-day app-managed free trial. This trial is provided and tracked by Zestro; it is not a Google Play Store or Apple App Store subscription trial. No payment method is required to start the trial. During the trial, users can access Start Cooking and Zestro's guided voice cooking features.

The free trial is available once per user and once per device. Attempts to obtain multiple free trials by creating new accounts, using different email addresses, or any other method constitute misuse of the trial system and are a violation of these Terms.

After the trial ends, users may continue generating, viewing, and saving meals and recipes. An active subscription is required only to use Start Cooking, including guided or voice-assisted cooking. Your cookbook, saved recipes, and generated meals remain accessible without an active subscription.

5. Subscriptions and Billing

5.1 Subscription Plans

After your free trial ends, continued access to Start Cooking and guided voice cooking requires a paid subscription. We offer a monthly plan and an annual plan. Current prices, billing periods, and applicable taxes or charges are displayed on the App's purchase screen or in the relevant store checkout before you complete a purchase. We reserve the right to change subscription prices with reasonable advance notice where required by applicable law or store rules.

5.2 Billing

Subscriptions are billed in advance on a monthly or annual basis depending on the plan you select. Android subscription payments are processed by Google Play. When Zestro becomes available on iOS, Apple will process iOS subscription payments through the Apple App Store. By subscribing, you authorise the applicable store to charge the payment method associated with your store account on a recurring basis until you cancel.

Zestro uses RevenueCat to manage subscription status and entitlements across the App. RevenueCat does not process your card payment; payment processing is handled by Google Play or, when iOS becomes available, Apple.

5.3 Cancellation

Subscriptions can be managed or cancelled through the Google Play Store or Apple App Store account used to make the purchase. Cancellation takes effect at the end of the current billing period, and you will continue to have access to Start Cooking and guided voice cooking until then. Deleting your Zestro account does not automatically cancel an active Google Play or Apple subscription.

5.4 What Happens After Cancellation

When your subscription ends, Start Cooking and guided voice cooking will no longer be available. You may continue generating, viewing, and saving meals and recipes, and your personal cookbook, saved recipes, and generated meal history will remain accessible. Your data will not be deleted simply because your subscription has lapsed. You can resubscribe at any time to regain access to guided voice cooking.

5.5 Refund Policy

Refund requests are governed by the refund policy of the store through which the subscription was purchased and by applicable law. Requests for Android purchases must be made through Google Play. When iOS subscriptions become available, requests for iOS purchases must be made through Apple. Cancelling a subscription does not automatically issue a refund for the current billing period.

6. Acceptable Use

You agree to use Zestro only for personal, non-commercial purposes. You may not use Zestro for professional kitchen or commercial food service operations without our express written permission.

You agree not to:

• Use the App in any way that violates applicable laws or regulations.
• Attempt to gain unauthorised access to any part of the App or its infrastructure.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use automated tools, bots, or scripts to access or interact with the App.
• Abuse, harass, or attempt to manipulate the AI chef system.
• Share your account credentials with others or allow multiple people to use a single account.
• Create multiple accounts to abuse the free trial system.

7. Intellectual Property

All content, features, functionality, design, trademarks, and technology within the Zestro App are owned by Parallax Labs LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the App without our express written permission.

The recipes generated by Zestro for you during your use of the App are provided for your personal use. You are free to cook from them, save them to your cookbook, and share them personally. You may not commercially exploit AI-generated recipes from Zestro without our written consent.

8. Disclaimer of Warranties

Zestro is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or completely secure.

AI-generated content, including meal suggestions, recipes, macro calculations, and cooking instructions, is provided for general guidance purposes only. While we work hard to ensure accuracy, AI systems can make mistakes. Macro and nutritional information is an estimate and should not be relied upon as precise nutritional data, particularly for medical dietary management.

Dietary and allergen information generated by the AI chef is based on the profile information you provide. It is your responsibility to verify that any meal or ingredient is safe for your specific condition, allergy, or health situation before consuming it. We strongly recommend consulting a healthcare professional before making significant dietary changes based on information provided by the App.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Parallax Labs LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Zestro, including but not limited to:

• Any adverse health reaction, allergic reaction, or medical event resulting from following meal suggestions or cooking guidance provided by the App.
• Inaccuracies in nutritional or macro information generated by the AI.
• Loss of data, cookbook content, or cooking history.
• Service interruptions or technical failures.

Our total liability to you for any claim arising from your use of Zestro shall not exceed the amount you paid to us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you.

10. Account Termination

We reserve the right to suspend or terminate your account and access to Zestro at our sole discretion, with or without notice, for the following reasons:

• Violation of these Terms of Service.
• Abuse of the free trial system, including creating multiple accounts to obtain additional trial periods.
• Fraudulent chargebacks or payment disputes made in bad faith.
• Any conduct that we reasonably believe is harmful to other users, to us, or to third parties.
• Any illegal or unauthorised use of the App.

You may delete your account at any time through the App settings. Upon account deletion, all your personal data will be permanently removed within 30 days in accordance with our Privacy Policy. Deleting your Zestro account does not cancel a subscription purchased through Google Play or Apple. You must cancel that subscription separately through the store account used to make the purchase.

11. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law principles.

We encourage you to contact us first at legal@tryzestro.com to resolve any dispute informally. We will make every reasonable effort to resolve concerns quickly and fairly.

If informal resolution is not possible, any dispute arising out of or relating to these Terms or your use of Zestro shall be resolved through binding individual arbitration under the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction in New Mexico to prevent irreparable harm.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by email at least 14 days before the changes take effect. Your continued use of Zestro after the effective date of the updated Terms constitutes your acceptance of the new Terms.

If you do not agree to the updated Terms, you must stop using the App before the changes take effect.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Parallax Labs LLC regarding your use of Zestro and supersede all prior agreements, understandings, and communications between us relating to the subject matter herein.
